The worlds of law, psychotherapy and conflict resolution intersect in a variety of challenging contexts. The constructive problem-solving processes of collaborative law and mediation are particularly well-suited for reaching agreements where the parties have an interest in preserving or enhancing their relationship or where a traditional adversarial or legal avenue would be undesirable, unavailable or unnecessarily expensive. Consulting and review attorney advises individuals who are in mediation and would like an individual consultation either during the process or prior to signing their agreement. Collaborative Mediator helps to mediate impasses between spouses who are engaged in ligigations or a collaborative law process. Pre-nuptial and domestic partnership agreements are ideally suited to the forward-looking, non-adversarial processes of mediation and collaborative law. Family mediation helps families reach agreement on issues concerning finances, parenting, eldercare, or any other issue which requires collaborative decision-making. Members of immediate as well as extended families can benefit from mediating their differences. Gay and lesbian couples and unmarried heterosexual couples who wish to use collaborative law or mediation to resolve and formalize an agreement on the issues surrounding a separation, such as finances and parenting rights and responsibilities, will be assured of a safe, respectful and private setting. These couples are listed here as a separate category only because the legal procedures involved are distinct from separation and divorce of a marriage currently recognized by the State of New York and for no other reason. Family business mediation recognizes the personal and emotional context in which disputes and differences arise in the challenging business environment. Here, family business members collaborate to achieve common objectives and heal old wounds that may be impeding their optimal functioning and success. Organizational mediation identifies and helps work through roadblocks to successful collaboration among co-workers, board members, and between management and staff. Such mediation can take place between two individuals whose common objectives are overshadowed by personal or emotional conflict or among a larger group where interpersonal dynamics are inhibiting creativity, productivity and overall organizational well-being. |
